Sudan’s Justice Minister: Al-Burhan Issues Written Guarantees for a Safe Sudanese-Sudanese Dialogue

Sudan's Minister of Justice, Dr. Abdalla Dirif, announced that the President of the Transitional Sovereignty Council (TSC), General Abdel Fattah Al-Burhan, is issuing written guarantees to create a safe environment for the launch of the Sudanese-Sudanese dialogue.

Dirif reaffirmed the state's commitment to providing an appropriate environment and the necessary freedoms to ensure the success of the dialogue process.

Speaking at a press conference in Khartoum, he said Al-Burhan had approved the dismissal of public-rights cases against participants covered by the dialogue guarantees, as well as the provision of written assurances enabling them to participate in the political process without facing legal action because of positions they have taken or opinions they have expressed in connection with the dialogue.

The Minister of Justice stressed that the state would not initiate criminal proceedings against any citizen because of an opinion expressed regarding the dialogue. He said the guarantees also prohibit criminal action over views expressed during consultations or the dialogue itself, provided that such views are related to the process.

Dirif said Sovereignty Council Decision No. 363 requires judicial, police and security authorities to implement the guarantees established for the dialogue.

He emphasized that the state's role would be limited to creating suitable conditions and providing the necessary protection, facilitation and freedoms, without interfering in determining the dialogue's participants, agenda, timetable or outcomes. “The government is not a party to the dialogue and will not determine its participants or schedule,” he said.

He added that Sudanese nationals returning to the country to participate in the consultations or dialogue would also be covered by the guarantees provided to participants, allowing them to take part in a safe environment.

The minister clarified that the procedural immunity granted to participants would apply only for the duration of the dialogue. He said the decision concerns the dismissal of cases related to public rights and does not provide permanent or blanket immunity from legal accountability.

Regarding fighters, Dirif confirmed that any combatant who voluntarily surrenders is covered by a previously issued amnesty decision, rather than the decision governing guarantees for the Sudanese-Sudanese dialogue.
